Harassment Policy

June 2004

It is the policy of the Appalachian Fiddle & Bluegrass Association (A.F.B.A.) to provide a safe and secure environment for all it's members and guests without distinction to enjoy all the programs, activities and opportunities afforded to them without regard to race, color, sex, creed, religion, national origin, sexual orientation or disability.

 

The A.F.B.A. is committed to the prevention, remediation, and accurate reporting of harassment, bias incidents, and civil rights violations based upon sex/gender, race, color, national origin, ancestry, religion, age, disability, sexual orientation, and any other class or characteristic protected by the law.

 

This policy has been implemented to ensure that the enjoyment of bluegrass music at Mountain View Park and at any other A.F.B.A. function held off premises of the park.

No member or guest of the A.F.B.A. should ever feel threatened or limited by such violations or harassment, and to ensure the differences are respected and individuals are free to experience all that the A.F.B.A. has to offer without fear of intimidation, humiliation or degradation.

 

Discrimination, sexual and bias-motivated harassment, and violations of the civil rights disrupt the Bluegrass experience and will not be tolerated.

 

This policy defines:

 

Unlawful and prohibited conduct

 

Reporting and investigation procedures

 

Disciplinary sanctions

 

 

Unlawful & prohibited conduct defined:

It shall be a violation of this policy for any member or guest of the A.F.B.A. to harass or discriminate against another member or guest of this association. Discrimination occurs when an individual or group is treated adversely in an A.F.B.A. setting (or at an event held on A.F.B.A. property, whether owned by the A.F.B.A. or rented). Discrimination solely based on their sex/gender, race, color, national origin, ancestry, religion, age, disability or sexual orientation shall included by not be limited to , unwelcome actions which are related to a person's sex/gender, race, color, national origin, ancestry, religion, age, disability, or sexual orientation. In all cases, such actions will be considered unwelcome, and especially in the event it involves very young guests of the association will be considered an extreme violation of this policy.

 

Harassment based on sex/ gender, race, color, national origin, ancestry, religion, age, disability or sexual orientation consists of the conduct that:

 

Has purpose or effect of creating an intimidating, hostile, humiliating or offensive environment within the A.F.B.A. grounds or functions.

 

Has the purpose of substantially or unreasonably interfering with a person's ability to attend or enjoy the A.F.B.A. grounds or functions.

 

Or otherwise adversely effects a persons ability to feel they are welcome at the A.F.B.A. property or welcome to return to the property for another event or adversely effects a persons ability to feel welcome to join or renew membership with the A.F.B.A.

 

 

Sexual / Gender Harassment:

In this association sexual harassment , whether verbal or physical in unacceptable and will not be tolerated. Sexual harassment is unlawful and hurts all people. Sexual harassment is unwanted attention directed toward a person because of his or her gender. Unlawful and prohibited conducts consists of unwelcome sexual advances, requests for sexual favors, sexually motivated physical conduct, or other verbal or physical conduct or communication of a sexual nature when:

 

Submission to or rejection of such conduct or communication is made explicitly or implicitly a term or condition of membership, office or entrance into an A.F.B.A. property or function. (whether owned or rented by the A.F.B.A.).

 

Such behavior unreasonably interferes with an individual's ability to enter on to association property or event at a rented facility, to join or re-new membership with the association, or to be nominated, run for or hold a position as an officer of the A.F.B.A.

 

Sexual harassment can include advances, requests or conduct directed from male to female, male to male, or female to female.

 

 

Reporting & Investigation procedures:

 

Any person(s) who feel they have been discrimination against as outlined above is to immediately report such to any officer or member of the A.F.B.A. Incidents can also be reported to the A.F.B.A. at the following addresses:

Please include in your complaint the date, time and event at which you feel you were discriminated against. Please provide witnesses if available to substantiate your claim. Under no circumstances should an event go unreported due to a lack of witnesses.

 

A panel will be created consisting of but not limited to A.F.B.A. officers and members and may contain an outside, unbiased person, authority or another association to fairly evaluate and make a conclusion based on this complaint.

 

 

Disciplinary sanctions:

 

Any member or guest of the A.F.B.A. found in violation of this policy will be immediately removed from the premises and in the event is a member of the A.F.B.A. , that member will immediately have their membership revoked permanently with no chance of re-establishing such membership with the A.F.B.A. This person(s) will no longer be allowed on A.F.B.A. property or at any A.F.B.A. function.
